These Terms and Conditions of Sale (the "Terms") govern all sales concluded between GUIKAS, operated by HLS SAS, and any individual acting as a consumer (the "Customer") who purchases products through the website www.guikas.com (the "Website").

By placing an order on the Website, the Customer acknowledges having read and accepted these Terms without reservation.

2. Products

GUIKAS designs and sells 18-karat gold jewelry, with or without precious or semi-precious gemstones.

Each piece is crafted with the utmost care by our partner workshops in accordance with the highest standards of fine jewelry craftsmanship.

The photographs, videos, and product descriptions displayed on the Website are presented as accurately as possible. However, they are provided for informational purposes only and do not constitute contractual representations. In particular, slight differences may occur due to the display settings of individual devices and screens.

The natural gemstones used by GUIKAS possess characteristics inherent to their origin. Slight variations in color, texture, inclusions, or shade may exist from one piece of jewelry to another. These natural variations reflect the authenticity of each stone and contribute to the uniqueness of every creation. They shall not be considered defects or non-conformities.

The dimensions and weights provided are for information purposes only and may vary slightly.

3. Availability

At present, all jewelry offered on the Website is made exclusively to order.

This production method enables GUIKAS to minimize inventory and create each piece specifically for its Customer.

Should a material, gemstone, or essential component required to fulfill an order become exceptionally unavailable, GUIKAS will inform the Customer as soon as reasonably possible.

The Customer may then choose to accept an extended production time or cancel the order and receive a full refund of all amounts paid.

4. Prices

Prices are displayed in euros (€) and include all applicable taxes (VAT included) for orders delivered within the European Union.

For deliveries outside the European Union, customs duties, local taxes, import duties, or other charges may be imposed by the authorities of the destination country. Such charges shall be borne exclusively by the Customer.

GUIKAS reserves the right to modify its prices at any time.

However, products will be invoiced at the price in effect at the time the order is confirmed.

Shipping is free of charge.

5. Orders

An order shall be deemed final once payment has been successfully validated and the order confirmation email has been sent by GUIKAS.

The Customer warrants that all information provided during the ordering process, including billing and shipping details, is accurate and complete.

GUIKAS reserves the right to refuse or cancel any order in the event of confirmed or suspected fraud, a previous dispute with the Customer, non-payment, or any other legitimate circumstance preventing the proper execution of the order.

6. Payment

All payments are processed in euros (€).

The accepted payment methods are those offered during the checkout process, including:

  • Credit or debit card (Visa, Mastercard, and American Express)
  • Apple Pay
  • Google Pay
  • Shop Pay

The total amount of the order is charged at the time the order is confirmed.

All payments are processed securely through payment service providers selected by GUIKAS.

At no time does GUIKAS have access to or store the Customer's payment card details.

7. Made-to-Order Production

Each GUIKAS jewelry piece is made to order.

The production times indicated on the Website are provided for information purposes only and may exceptionally be extended due to a high volume of orders, the annual closure of our workshops, supply delays, or any other circumstances beyond GUIKAS's reasonable control.

In the event of a significant delay, GUIKAS undertakes to inform the Customer as soon as reasonably possible.

8. Delivery

GUIKAS delivers its jewelry throughout France and internationally.

The delivery times indicated on the Website include both the production time and the shipping time. They are provided for information purposes only.

Shipping is free of charge.

Orders are shipped to the delivery address provided by the Customer when placing the order. It is the Customer's responsibility to ensure that all information provided is accurate. GUIKAS shall not be held liable for any delay or failure in delivery resulting from an incomplete or incorrect address.

For orders shipped outside the European Union, customs duties, taxes, or import charges may be imposed by the authorities of the destination country. Such charges shall be borne exclusively by the Customer.

In accordance with the provisions of the French Consumer Code, the risk relating to the products passes to the Customer when the Customer, or a third party designated by the Customer, takes physical possession of the order.


9. Receipt of the Order

Customers are encouraged to inspect their parcel immediately upon delivery.

If the parcel is damaged, opened, or shows any apparent irregularity, the Customer should make the appropriate reservations with the carrier and contact GUIKAS as soon as possible at contact@guikas.com, enclosing photographs of the parcel and the affected product(s).

GUIKAS undertakes to assist the Customer in finding an appropriate solution as quickly as possible.

10. Right of Withdrawal

In accordance with the provisions of the French Consumer Code, the Customer has a period of fourteen (14) days from the date of receipt of the order to exercise the right of withdrawal, without having to provide any reason.

To exercise this right, the Customer must send their request to contact@guikas.com before the withdrawal period expires.

The jewelry must be returned in its original condition, unworn and unused, together with its presentation box, certificate of authenticity (where applicable), and all accessories supplied upon delivery.

Return shipping costs are fully covered by GUIKAS. However, the Customer must wait for the return instructions provided by GUIKAS before sending the item back.

Once the returned product has been received and inspected, GUIKAS will issue a refund within a maximum of fourteen (14) days, using the same payment method used for the original purchase, unless the Customer expressly agrees to another method.

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to jewelry made to the Customer's specifications or clearly personalized, including, but not limited to, engraved items, bespoke creations, size modifications, the selection of specific gemstones, or any other customization requested by the Customer.

Such orders are final and may not be cancelled, returned, or refunded, except in the event of a lack of conformity or a defect covered by the applicable statutory warranties.

11. Returns and Exchanges

Apart from the right of withdrawal set out in the previous section, returns and exchanges are not accepted automatically.

Any request submitted to GUIKAS will be reviewed on a case-by-case basis in order to determine the most appropriate solution.

No return will be accepted if the jewelry:

  • has been worn, used, or shows signs of wear;
  • has been damaged, altered, or repaired by a third party;
  • is returned incomplete, without its presentation box, certificate of authenticity (where applicable), or any accessories originally supplied.

Custom-made or personalized jewelry cannot be returned, exchanged, or refunded, except in the event of a lack of conformity or a defect covered by the applicable statutory warranties.

12. Warranties

GUIKAS jewelry is covered by the statutory warranties provided under the French Consumer Code and the French Civil Code, including:

  • the statutory warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code);
  • the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

These statutory warranties apply independently of any commercial warranty.

In addition, GUIKAS provides a one (1) year commercial warranty from the date the jewelry is received.

This commercial warranty covers manufacturing defects only, provided the jewelry has been used under normal conditions.

The warranty does not cover, in particular:

  • normal wear and tear resulting from regular use;
  • scratches, impacts, deformation, or accidental breakage;
  • loss or theft;
  • damage resulting from misuse or improper maintenance;
  • repairs or modifications carried out by any third party not authorized by GUIKAS.

Any warranty claim must be submitted to contact@guikas.com, together with photographs showing the alleged defect. Where necessary, GUIKAS may request that the jewelry be returned for inspection.

13. Repairs and After-Sales Service

GUIKAS offers repair, maintenance, and restoration services for its jewelry.

Each request will be reviewed in advance to determine the nature of the required work and, where applicable, the associated cost.

Where the repair is covered by the warranty, it will be carried out at no cost to the Customer.

In all other cases, a quotation will be provided to the Customer before any work is undertaken.

GUIKAS reserves the right to refuse to repair any jewelry that has been altered or repaired by an unauthorized third party.

14. Liability

GUIKAS shall not be held liable for any failure or delay in performing its obligations where such failure or delay results from an event of force majeure as defined under French law or from any circumstance beyond its reasonable control.

GUIKAS shall not be liable for any damage resulting from:

  • improper use of the jewelry;
  • inadequate maintenance;
  • use of the jewelry for purposes other than those for which it is intended;
  • any intervention carried out by a third party.

Nothing in these Terms shall affect the Customer's rights under the applicable statutory warranties.

15. Intellectual Property

All content available on the Website, including but not limited to text, photographs, videos, illustrations, graphic works, logos, drawings, models, jewelry, designs, and any other materials, is protected by applicable intellectual property laws.

Such content remains the exclusive property of GUIKAS or its respective rights holders.

Any reproduction, representation, adaptation, distribution, exploitation, or use, in whole or in part, in any form whatsoever, without the prior written authorization of GUIKAS, is strictly prohibited.

16. Personal Data

Personal data collected in connection with orders is processed in accordance with Regulation (EU) 2016/679 of April 27, 2016 (GDPR) and applicable French legislation.

Details regarding the collection, processing, storage of personal data, and the exercise of data subjects' rights are set out in the Privacy Policy available on the Website.

17. Governing Law and Dispute Resolution

These Terms and Conditions of Sale shall be governed by and construed in accordance with French law.

In the event of any dispute concerning the interpretation or performance of these Terms, the Customer is invited to contact GUIKAS first in order to seek an amicable resolution.

If no amicable solution can be reached, the Customer may refer the matter, free of charge, to the following consumer mediator after first submitting a written complaint to GUIKAS and failing to obtain a satisfactory response:

Where applicable, the Customer may also submit a complaint through the European Online Dispute Resolution (ODR) platform.

If no amicable settlement can be reached, any dispute shall be submitted to the competent French courts.
